Maryland Real Estate Commission Meeting – October 15, 2025

Below are some of highlights from October’s Maryland Real Estate Commission meeting.  

Advertising Task Force Begins Work on Updated Guidelines

The Maryland Real Estate Commission’s Advertising Task Force has officially kicked off its work, holding its first meeting on October 1 with strong participation from industry stakeholders, including Maryland REALTORS. The task force is reviewing advertising standards across all mediums, including signage, print, online, and social media to help ensure that compliance guidance reflects today’s advertising landscape. Once finalized, the revisions to MREC’s Advertising Checklist, incorporating the recommendations from the Task Force will be presented to the Commission for approval and as soon as it is available, we will be sure to let you know!

Land Records Access and Due Diligence

During her comments, the Chair emphasized the importance of every licensee maintaining and using a Maryland Land Records account to verify property ownership and listing authority. She noted that while recent discussions have focused on access fees, the key takeaway remains the continued need for this essential due diligence tool. 

The Chair also highlighted ongoing issues where properties have been listed without proper authorization, particularly in situations involving probate or divorce, or when the property's ground rent status was not verified. Because some of these cases have resulted in licensees being held responsible for failing to confirm this information, she reiterated that verifying ownership, confirming a seller's authority to list, and checking for probate, divorce, or ground rent matters are all critical to protecting consumers and avoiding liability. 

Proposal - Continuing Education Late Fee

The Commission shared that their regulatory proposal to separate the existing “Reinstatement Fee” into two categories is moving forward through the regulatory process. Currently, the same fee applies to both licensees who are late completing CE and those reinstating an expired license. This change aims to ensure fairness by assessing lower penalties for licensees who are otherwise in good standing but miss their CE deadline.

Under the proposal:

  • A true license Reinstatement Fee would remain at $168
  • A new CE Late Completion Fee would be set at $75

This proposed regulatory change was submitted to the Secretary’s office as part of the regulatory review process and will not take effect until final approval.

Real Estate Commission Update – CE Course Approval Fee

The Maryland Real Estate Commission voted to set the Continuing Education (CE) course approval and renewal fee at $25, consistent with the amount previously established in statute before new legislation gave the Commission authority to set the fee directly. Keeping the fee unchanged will help maintain affordability for education providers and keep training costs lower for licensees. The proposal will continue through the regulatory process and will be published in the Maryland Register for public comment before final adoption.

The Commission Check Returns!

The Maryland Real Estate Commission’s Executive Director, Scott Lederer, has made it a top priority to strengthen communication between the Commission and Maryland’s more than 47,000 licensees. One of his early goals was to revive “The Commission Check,” the Commission’s official newsletter, which had not been published since 2022. We’re pleased to share that the November 2025 issue of The Commission Check was recently distributed via email to all licensees. This renewed communication effort is a great step toward keeping industry professionals informed about Commission updates.
