Maryland Real Estate Commission Meeting – January 21, 2026

Below are key updates from the Maryland Real Estate Commission’s January business meeting, including progress on advertising guidance, regulatory proposals, and Commission operations.

Advertising Checklist Update

The revisions recommended by the Advertising Checklist Taskforce to the content of the Advertising Checklist were approved by the Commission. Once the necessary formatting changes are made, this list will be made available.  

Continuing Education Late Fee and CE Course Approval Fee

Counsel reported that the public comment period has closed for two regulatory proposals previously approved by the Commission. These include the proposal establishing a separate continuing education late fee and the proposal setting the CE course approval fee for education providers at $25, consistent with the amount previously set in statute.

Counsel anticipates that, barring any unforeseen issues, the Commission will be able to take final action on both proposals at the February meeting. Following Commission approval, the regulations must be approved by the Secretary’s office and published in the Maryland Register before taking effect.

Revisions to the Disclosure and Disclaimer Form

The proposed regulatory changes revising the Disclosure and Disclaimer form are expected to be published in the Maryland Register on February 6, 2026. Once published, the public comment period will begin.

Advertising Complaint Process

The Executive Director also provided an overview of how advertising complaints are handled. Advertising concerns are reviewed to determine whether they are supported by documentation and constitute a valid complaint. When appropriate, the Executive Director will contact the licensees and brokers to let them know of the issue and allow them 30 days to correct or remove non-compliant advertising. If the advertisement is not fixed, the Executive Director will then refer the matter to the complaint department for further action.

Meeting Schedule Update

The Commission shared that the April meeting will be held on April 22 due to the ARELLO Mid-Year Conference. A scheduling adjustment is also anticipated for the September meeting due to the ARELLO Annual Conference.

The next Commission meeting is scheduled for Wednesday, February 19, 2026.
